Johnny Depp returns to the stand in civil trial against ex-wife Amber Heard

Johnny Depp returned to the stand Wednesday in the civil trial for his lawsuit against ex-wife Amber Heard.

Depp testified he only saw what his attorney Adam Waldman had said about Heard when he saw the counterclaim filed by his ex-wife.

Depp is suing Heard for libel for $50 million in Fairfax County Circuit Court over a December 2018 op-ed she wrote in The Washington Post describing herself as “a public figure representing domestic abuse.” His lawyers say he was defamed by the article even though it never mentioned his name. Heard is countersuing Depp for $100 million over the statements Waldman made about her to media.

Depp also responded to defense witnesses who had testified about an injury to his finger, a point of dispute in his and Heard’s accounts of their relationship. He affirmed his earlier testimony about it being injured when Heard allegedly threw a vodka bottle at him.

And Depp responded to testimony early Wednesday from supermodel Kate Moss, whom he had dated in the 1990s. He and Moss both said she had slipped on some stairs in Jamaica that were wet from rain. Heard had testified that she thought about rumors of the incident with Moss during a fight where she admitted to hitting Depp on some stairs.

The civil trial between Depp and Heard resumed Wednesday in what is the sixth and expected last week of the trial. 

Earlier Wednesday, his team had called Moss, who testified Depp did not push her down the stairs in an incident that Depp’s ex-wife Amber Heard had mentioned in testimony. 

“He never pushed me, kicked me, threw me down any stairs,” said Moss, who appeared via video link.

Heard had referenced Moss as she described a fight in which she admitted hitting Depp on a staircase because she said Depp was charging at Heard’s sister, Whitney. Moss said she did once slip down a flight of stairs after a rainstorm at a Jamaican resort, and that Depp came to her aid.

The supermodel testified for less than 5 minutes and was not cross-examined.

Earlier, Heard testified that during a 2015 fight she recalled an alleged incident of Depp pushing Moss down a staircase. That opened the door for Depp’s attorneys to call Moss to the stand. 

Depp has denied he ever struck Heard, and says she was the abuser in the relationship. Heard has testified about more than a dozen separate instances of physical abuse she says she suffered at Depp’s hands.
